Comment: While Iran and Oman share control over the Strait of Homuz as their overlapping and sovereign Territorial Waters, both countries must abide by international maritime law, specifically by the right of “transit passage” for ships under the United Nations Convention on the Law of the Sea (UNCLOS). Although Iran initially signed UNCLOS, it has never ratified it. This is not an isolated situation. For example, Israel did not join the International Atomic Energy Agency (IAEA) and therefore insists that it does not have to abide by its restrictions and requirements regarding the proliferation of nuclear weapons.
